1. Acceptance of These Terms

These Terms of Service (the “Terms”) govern your access to and use of the website nomadrift.ink (the “Site”) and any educational materials, lessons, downloads, or communications provided through the Site (collectively, the “Services”). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

You must be at least 16 years old to use the Services. If you are under 18, you confirm that you have permission from a parent or legal guardian to use the Services and that they have reviewed these Terms with you. If you do not agree to these Terms, do not use the Site.

2. Educational Nature and Sewing Safety Disclaimer

The Services are educational. The content focuses on sewing techniques and textile decision-making, including but not limited to print placement, repeat analysis, engineered panel alignment, fabric pairing, cutting layouts, basting routines, and professional finishing methods. Any guidance is general in nature and intended to support learning and practice.

Sewing involves tools and equipment that can be hazardous, including cutting tools, rotary cutters, needles, irons, steam, and sewing machines. You are responsible for safe working practices, including keeping tools sharp and properly stored, following manufacturer instructions, using appropriate protective measures, and maintaining a safe workspace. Test stitches and pressing temperature on scraps before applying techniques to your main fabric.

Results vary. Fabric behavior differs by fiber content, weave/knit structure, finish, dye method, print application, and care requirements. The final outcome also depends on your tools, your pattern, and your technique. The Services do not provide workplace safety training and are not a substitute for professional manufacturing instruction or supervision.

3. Description of the Services

nomadrift.ink provides online learning resources about sewing garments using designer fabrics and unique prints. This may include structured courses, lesson text, images, checklists, examples of placement maps, and guidance on process sequencing (for example: analyze the fabric, plan placement, cut with grainline discipline, then sew and finish with a pressing map).

We may add, remove, update, or restructure content and features over time. We may also suspend or discontinue portions of the Services at any time. We aim to keep the Site available, but we do not guarantee uninterrupted access, specific course availability, or that any particular technique will be included on a specific schedule.

4. Registration Information and Communications

If the Site offers registration or requests contact details, you agree to provide accurate, current information. Do not impersonate another person or submit information you do not have the right to use. You are responsible for maintaining the confidentiality of any credentials you create (including passwords) and for activity associated with your submissions.

5. Acceptable Use

You agree to use the Site lawfully and responsibly. You must not:

  • Scrape, crawl, or harvest content or data from the Site using automated means without our prior written permission.

The Site and its content—including course text, images, layouts, design elements, illustrations, and instructional materials—are owned by or licensed to the operator of nomadrift.ink and are protected by intellectual property laws. All rights not expressly granted are reserved.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial educational purposes. You may not copy, reproduce, distribute, publicly display, modify, create derivative works from, or otherwise exploit the content without prior written permission, except where such use is permitted by law.

7. Third-Party Services and Links

The Site may reference third-party services or resources (for example, tools, manufacturers, or care guidance). Any third-party links are provided for convenience only. We do not control those websites or resources and are not responsible for their content, policies, or availability. Your use of third-party services is at your own risk and subject to their terms.

8. Disclaimer of Warranties

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free from harmful components. We do not warrant that any content is complete, current, or suitable for your specific fabric, pattern, tools, or skill level. Any reliance on the content is at your own discretion and risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Services.

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Services is limited to the greater of (a) the amount you paid to us for the Services in the 12 months immediately preceding the event giving rise to the claim, or (b) €100.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability will be limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Látky od Janečků and its owners, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Services, (b) your violation of these Terms, or (c) your violation of any applicable law or third-party rights.

11. Force Majeure

We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including events such as natural disasters, acts of government, labor disputes, war, terrorism, pandemics, internet or telecommunications outages, cyberattacks, or failures of hosting, cloud, or third-party infrastructure providers.

12. International Use

The Services are operated from the Czech Republic. We make no representation that the Services are appropriate or available for use in all jurisdictions. You are responsible for complying with local laws that may apply to your access to and use of the Site.

13. Governing Law and Venue

These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law principles. Any disputes arising out of or relating to these Terms or the Services will be subject to the competent courts in the Czech Republic.

If you are a consumer in the European Union, you may also have mandatory consumer protection rights under the laws of your country of residence. Nothing in these Terms limits those rights where they apply.

14. Termination

We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms, created risk, or misused the Site. Upon termination, the license granted to you under these Terms will cease.

Sections that by their nature should survive termination will survive, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.

15. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.

16. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Services and supersede any prior or contemporaneous agreements or understandings.

17. Assignment

We may assign or transfer these Terms, in whole or in part, including to a successor in interest in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign these Terms without our prior written consent.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative.

19. Modifications to These Terms

We may update these Terms from time to time. Changes will be effective 14 days after posting the revised Terms on this page, unless a change is required by law or is needed to address security or operational issues sooner. The “Last Updated” date indicates when the Terms were most recently revised.

20. Electronic Communications

By using the Services, you consent to receiving communications electronically. Notices and disclosures may be provided via the Site or by email. You agree that electronic communications satisfy any legal requirement that such communications be in writing.
